In the Name of God Amen I Thomas Osborne of Erdington in the Parish of Aston in the County of Warwick Yeoman being at present of sound Mind & Memory praised be God for the same Do make & publish this my last Will & Testament in manner following First I give & bequeath to William Peacock brother to my late Wife the Sum of Ten pounds if he lives till my Executors have made sale enough of my personal Estate after payment of my Debts & Funeral Charges & then to be immediately paid him Item I give to my Servant Elizabeth Turner if she continues in my Service till my Decease (but not otherwise) the Sum of Five Pounds & I do hereby constitute & appoint John Cater Wheelwright of Minsworth in the Parish of Curdworth in the County of Warwick and John Rogers Yeoman of Erdington in the Parish of Aston in the County of Warwick Joint Executors of this my last Will & Testament & I give the Sum of One Pound a piece unto such of them my Executors as shall take on them the Burthen & Execution thereof as an acknowledgement for their care & Trouble in & about the same As to all the Rest Residue & Remainder of my personal Estate of what Nature Kind or Quality soever the same be not by me otherwise disposed of after & subject to the payment of my Debts Legacies & ffunerall Expences I give & bequeath the same & every part thereof unto my said Executors Upon Trust that they my said Executors or the Survivor of them his Heirs Executors Administrators or Assigns shall & do as soon as conveniently may be after my decease consistent with the delay which may be necessary on account of the Occupation of my Farms sell & convert into ready Money all such part or parts thereof as shall not consist in Money and the Money arising by such sale I desire the said John Rogers to receive together with any Money which may be found in the House and any Debts which may be due to me and immediately to deposit the same in the hands of my Landlord Mr Holden for safe Custody & his receipt shall be a discharge to my Executors Item I give and bequeath the Money so deposited in the Hands of Mr Holden to John Cater Mary Cater William Cater & Catherine Cater the Sons & Daughters of John Cater the Executor herein before mentioned by Elizabeth his present Wife to be equally divided between them and their Shares to be paid by the said Mr Holden when they attain the Age of Twenty One Years & I would have each of those Children paid their Shares as soon as they come of Age & not to stay till the others come of Age & in case any one or more of the said Children die before such Child or Children attain the Age of Twenty One Years then and in such case I give the Share or Shares of such Child or Children so dying to be equally divided between them who survive when they come of Age in the same manner as is above directed for the payment of their Original Shares In Witness whereof I the Testator Thomas Osborne have to this my last Will & Testament set my Hand and Seal 30 Sept 1753
